Thank you for checking out my commissions page. Please take some time to check out my Terms of Service (TOS) below. By requesting a commission, you are fully agreeing to all terms outlined here unless discussed otherwise over email.
Please keep in mind that I take my TOS very seriously.
Once I accept the commission request, we will enter a legally binding contract between a client and a service provider.
I do not discuss commission requests and agreements over Discord due to the ease of editing/deleting messages on that platform. For requests, further details or negotiations, please email me at honeytoastie@gmail.com
DON'T BREAK MY RULES, especially regarding AI and NFT/Crypto. I'll actually take legal action and come for your ass. If you're worried about the $$$ fine; I think it's best to look somewhere else. I'm not interested in doing business with people who are trying to break/bypass my TOS or looking for ways to be shady.
As long as you're honest and not looking to break the rules/ToS, we shouldn't have any problems!
Terms of Service
What to expect:

There are x2 checkpoints. Sketch stage and color flats. Sketch is to confirm posing and general composition, flats to confirm the finished line-work and base colors of all elements. You will get one revision at each stage so please check over the Work-In-Progress (WIP) images carefully.

There will be a 7-day waiting period for your feedback/response. If I don't hear from you within that time, your commission will be delayed. If I don't hear from you in 1 month of last correspondence, the commission will be cancelled and no refunds will be given.

I will do my best to finish the commissions in 2-3 weeks of starting (this is not payment date). You will be informed when I start working on your commission.

This is a digital illustration service. No physical product will be provided unless previously discussed and agreed upon when making the order.

The commissioner may only purchase commercial licenses for the commissioned pieces if they hold intellectual property rights for the subjects commissioned. This is the commissioner's responsibility and I will not take responsibility for the misuse of my work.

All prices are in USD.

I only accept Stripe and Ko-Fi payments at this time. You will not require a Stripe account to pay and can accept most major payment methods. Ko-Fi requires an account to make payments.

The commission/s are non-refundable once I begin working on your request.

Payment is due in full, up-front when the commission request is accepted and added to the queue.

Partial payment plans can be arranged for orders over $200. No refunds will be given of the partial payments made if the clients decide to drop off. Once full payment is made, the order will be added to the queue.

The commission will only be delivered once the full account have been paid.

Assets for livestreaming and YouTube is considered a commercial purpose, even if the commissioned piece is not sold directly, it is part of public branding for a monetized project.
Terms & Conditions:

You must honestly state the intended purpose of the commission (personal collection, livestreaming, merchandise production etc.) when submitting your request.

Commissioned pieces may NEVER be used for/as NFTs (or any kind of cryptocurrency) or to be used in any part of AI image generation process and result.

Commissions pricing listed on this page are for private use only (personal collection, gift to friend etc) and may not be manipulated, reproduced/printed for ANY financial gain or commercial purpose unless commercial rights are purchased.

Any edit and/or removal of my signature/artist attribution from the piece is prohibited.
- Printing the piece for personal use, or as gifts to friends is completely acceptable and encouraged!
- Showing the commissioned piece on stream or video is absolutely acceptable as long as it is not used to promote/represent the content creator.
- The commissioner can post the commissioned piece on their social media as long as I am credited/attributed as the artist for the piece. Please use @blackeye_toast when including your credit info.
- Please communicate with me! Whether you're unsure of the outlined ToS, your intentions have changed and wanted to ask if it's considered commercial use or not etc. I am always happy to clarify and discuss these details.
My Rights:

I retain copyright of the commissioned illustration. (To clarify and prevent confusion on this point: I do not own the rights to the characters/subject of illustration. I just do the drawings, and I am the copyright holder of the drawings. No one else can claim that my work is theirs, not even the client).

I reserve the right to refuse requests that I find uncomfortable, or I am not confident in completing to an acceptable standard.

I am not obligated to support/promote/represent my client beyond the provided commissioned service.

I may stream the creation process of your commission. If you need it kept private until a specific date, please disclose this information in the request email.

I may post your commissioned work on my social media and websites for portfolio purposes. It will only be noted that the work is a commission.

Please provide visual references of all elements required in the commissioned piece. If you don't have them and would like me to interpret your written descriptions, a character designing fee will be added on top of the commission price. This is not the same as purchasing commercial rights.

Please keep in mind that I work on commissions in conjunction with other personal projects, conventions and other commitments. There will often be times when I do other artwork.
Commercial Use License:
Commercial Rights is the right to reproduce my artwork for the client's potential monetary benefit.

Online Marketing Commercial Use: Livestreaming/Content creation graphics, content promotion, marketing, branding, online identity representation. Additional +$100 USD

Physical / Direct Commercial Use: Direct sale of the commissioned piece via digital (paid download, wallpapers etc) or physical media (stickers, mugs, prints etc). x3 commission price.
Some Commission types include limited commercial use.

Commercial rights may be purchased after the delivery of the personal commission in cases where the intent of the piece has changed.
Please also note that Commercial Use does NOT mean you own the copyright to the drawing. You may not edit the commission or remove my signature/artist attribution from the piece.
Formal Agreement
Failure to follow the outlined Terms of Service and any other terms discussed by email prior to me accepting the commission request, may result in a $50,000 USD fine for each term of the contract that is broken.
This will be legally actionable by me, Ji Yeon Kim (Black Eye, @blackeye_toast), with reasonable discretion, on the grounds of the client breaking a formal contract with the service provider.
